From Pan Trinbago -- Pan Trinbago Injunction

On July 9, 2018, High Court Justice Joan-Charles continued an injunction first granted on May 17, 2018, preventing Mr. Keith Diaz, the President of Pan Trinbago Inc, from summoning a Special Convention of Pan Trinbago for the purpose of amending the constitution of Pan Trinbago.

The judge ruled that the Constitution of Pan Trinbago did not allow Mr. Diaz to convene a Special Convention of Pan Trinbago by giving only 10 days’ notice of the meeting to the members. The learned Judge found favour with the arguments of Farid Scoon, Attorney-at­Law of the other members of the Central Executive Committee of Pan Trinbago Inc., that a notice of only 10 days was wholly unreasonable given the seriousness of business that Mr. Diaz intended to conduct at the meeting.

The court ruled that the Defendant, Mr. Diaz, had breached the Constitution of Pan Trinbago issuing illegal notices to the members of the general body of Pan Trinbago to convene the meeting which was to be held on May 17, 2018. On the said May 17, 2018, the Judge granted a temporary injunction prohibiting the meeting and yesterday she continued the injunction until September 1, 2018. Pan Trinbago’s constitution provides for elections of the Central Executive Committee to be held between September 1 and October 31 every three years.

Mr. Diaz, the President of Pan Trinbago, has been at loggerheads with the rest of the Central Executive Committee, including Richard Forteau, Pan Trinbago’s Secretary, Andrew Salvador, Darren Sheppard, Michael Joseph, Allan Augustus and Trevor Reid.

On May 4, 2018, another High Court Judge Ronnie Boodoosingh, also granted an injunction quashing the decisions of an Extraordinary General Meeting of Pan Trinbago called by Mr. Diaz at which meeting, an Interim Executive Committee was purportedly elected by the members in attendance at that meeting to replace the duly elected Central Executive Committee. In his written judgment, Justice Boodoosingh granted an interim injunction restraining Mr. Diaz, Mr. Gerard Mendez, the North Trinidad chairman of Pan Trinbago and Marie Toby, the Tobago chairperson, from acting together with other persons to remove or displace Messrs. Forteau, Salvador, Sheppard, Joseph, Augustus and Reid. The Honourable Madame Justice Joan-Charles upheld the application of the Claimants from their offices as members of the Central Executive Committee of Pan Trinbago Inc.
