No election until the court case done; photo and Diaz have to remain there until.
Let me start by saying this is not fact, but speculation. However, based on my analysis this would not become a reality.
Yesterday I received numerous calls about the situation regarding Mr. Photo and his band of thieves taking the former president of Pan Trinbago and two regional officers to court. As far as the information I received, photo is claiming that the first meeting was unconstitutional because the bands did not get 28 days’ notice. They are also contesting the last meeting’s 60% membership requirement, for the petition and for the convening of the meeting, was not met. The action was brought against three people, Mr. Diaz the former president of Pan Trinbago, Mr. Mendez the chairman of the northern region and Mrs. Tobey the chairwoman from the Tobago region.
Before I give my thoughts on the matter, I would urge people of the pan movement to exercise some patience. I have heard some unspeakable actions being suggested as retaliation against Mr. photo for this court action. However, this was something that we expected, and now that it is upon us, we only need to deal with it professionally. Mr. photo and his gang, is within their right to defend their position, as long as it is not financed with pan Trinbago’s moneys.
As for the case, Mrs. Toby and Mr. Mendez have absolutely nothing to do with convening any General Meetings and they were not the people responsible for handing in the petition. I think they should sue photo and D. shepherd for some of Shepherd’s $95,000.00 of pan people’s money he just received from a photo-lead unconstitutional meeting, for defamation of character.
But the facts are that at the meeting on the 27th of March, the first meeting, no decision came out of that meeting. So it became a discussion. The president shared information with his membership, therefore there is no need for a 28 days’ notice. It is somewhat ironic that such a claim is coming from photo and his team, because he has been sending circulars to bands to attend meetings without the 28 days’ requirement. In addition, his accomplices sat at the head table on many occasions at such meetings.
As for the 295 bands he is claiming are in existence, it is nothing more than a joke. So if he thinks he could fight that in court, well best of luck to him. We have proof of how many financial bands there are. So it just needs to be presented in court. Furthermore, photo has been convening meetings without his new 295 bands total, including the last AGM where the membership voted him into office. He did not use 295 as the total bands needed to get a 60% quorum. Therefore, if we have to now use the 295 bands as he is claiming, it would mean that he was voted in without a quorum; holding office illegally and should demit office with immediate effect.
How would this affect elections?
It would not. The secretary is carrying the president to court. This case, as embarrassing as it is, is among people in their private capacity. For pan Trinbago to take anybody to court, it has to be a decision by the entire executive. Due to the fact that the executive is split, Pan Trinbago and its elections has nothing to do with that court case. Even after the election this case could continue. People are also of the opinion that the last court case instructed the executive to stay in place until the courts made a decision on the matter. That is not true. The membership at an AGM made the decision to keep the sitting executive in place pending the outcome of the case. Therefore, if the membership wants to remove the sitting executive pending the decision of the court, we can also exercise that option. Educate yourself and don’t let photo and his thieves mislead you any longer.

i actually suggested that awhile ago....... and it is an option that we are keeping open for the last resort..... but we are far from there. as far as i c it ..... the glass not half empty any more it is how 3/4 full.....

The best thing to do is start a new organization with the support of the majority of band then those guys will have no choice but to go, come on bands get cracking

All this BIG TALK about the MEMBERSHIP (The MEMBERSHIP of an organization is supreme; the OFFICERS serve at the pleasure of the membership) is just pure DELUSION. I am sure that THE MEMBERSHIP want their PANORAMA 2018 pay right now. If dey so supreme why don't they demand the money before it ends up in the hands of attorneys.
This MEMBERSHIP is POWERLESS. How come they sit down and watch THIRTY FOUR MILLION of their own money just disappear and with all their SUPREMACY sit down and not say a word. How come they never asked DOCTOR DOLLY to see the SUPPOSED AUDIT and how the money was spent.
Now Mr. Arrindell is trying to split hairs telling us about the courts having no jurisdiction over the calling of the next elections. Maybe the unspeakable actions being suggested as retaliation against Mr. photo for this court action might be the quickest resolution. (And it might even be singing "YEAR FOR LOVE" to him -- I did not see hear the specifics of the actions.)
Otherwise, we tie up in court for the next three years again.
Meanwhile, in America, THE PAN MOVEMENT is becoming more and more organized and making this country the TRUE MECCA of the STEELBAND. Yuh eh go find no KEITH DIAZ or FORTEAU running the Ellie Mannette program in West Virginia or the WHEN STEEL TALKS WEBSITE in New York or the MUSIC PROGRAM at NIU or the weteachpan.org in Ohio or the recording STEELBAND music with Tracy Thornton and some ROCK ICONS in Los Angeles or any of the STEELBAND PROGRAMS in the over 1000 schools across AMERICA ... Lord I could go ON and ON like BUBBA listing the many ways you could cook shrimp in FOREST GUMP.
If North and South Korea could call a TRUCE, I say is time for the PAN TRINBAGO EXECUTIVE to mend some fences and get this PAN PROGRESS down in Trinidad going.
And where is the MINISTER OF CULTURE in all this? Like she DOH LOVE PAN!!!
Yuh could call them (PT) all kinda names, but at the end of the day, pan people ain't nutten but a bunch of fools. What dey say? Fool me once, xyz...fool me twice , abc.......the big five or ten and the minnows/minions all lining up for panorama 2019. And the B E A T goes on and on and on and on.
