The opinion of a group of lawyers from the bush (not to be confused with bush lawyers), who suspect that Diaz's lawyer may have attained "Terylene" and confused it with "Silk" is:

Notwithstanding recommendations expressed by Boodoosingh in his earlier judgement, expressly stated in section 42 at the conclusion of his summary, is the clause, the order shall be as follow...

(i) AN INTERIM INJUNCTION IS GRANTED as requested by Forteau & Co. restraining Keith Diaz & Co. from removing or displacing the claimants Forteau & Co. from their offices...

(ii) AN INTERIM INJUNCTION IS GRANTED as requested by Forteau & Co. restraining Keith Diaz & Co. from constituting themselves... In other words, Keith Diaz & Co. has been restrained by an order of the court, from creating any caretaker committee to run the affairs of Pan Trinbago, or behaving, for want of a better term "Executive", because...

(iii) ...Boodoosingh goes on to rule in this sub-section that, the status quo prior to the creation of the caretaker committee is to remain UNTIL FURTHER NOTICE ( in other words, allow the executive to function as it usually does).

(iv) This sub-section is interesting, as it relates to the issue of costs which is yet inconclusive (although one side is already sharing the legal costs of the other), and is RESERVED UNTIL DETERMINATION OF THIS CLAIM (which means that both parties may have to return to the court relative to this claim, which brings into question suggestion of an appeal)

Boodoosingh in section 44 of his judgement, considering the substantial number of members that felt moved to express their dissatisfaction, goes on to make five (5) notable RECOMMENDATIONS,

  1. three (3) suggesting the method of transition at 14-17 Park Street
    • sit and discuss way forward.
    • bring forward elections - how to trigger special convention
    • find ways to work together until elections are due
  2. one (1) suggesting acceptable method of conflict resolution,
    • mediation or, conciliation - the action of stopping someone being angry, by mediating between two disputing people or groups (which would have mitigated the incidents at CWU and at 14-17 Park Street last week),
  3. one (1) suggesting the engagement of experts (professionals).

The lawyers from the bush (not to be confused with bush lawyers), would be inclined to suggest that it makes good sense to take Boodoosingh's advice, and act on any or all of his suggestions namely;

  • Quietly and meticulously prepare, and be prepared to share the vision for the way forward, which is not quite clear at present. 
  • Consider all pending court action that may potentially inhibit the capacity to constitutionally satisfy the demands of triggering a special convention, before doing so.
  • Ride it out until the duration of the current term with concrete plans to hit the ground running at the appointed time.

-Respect for the rule of law is important, as it's an acceptable and suitable foundation on which to build.

-Expect Forteau (for whom I hold no brief) not to lose this round.

  • I disagree with you on this one Claude, the Mexicans cannot negotiate like trinis. I love how the TT panmen resolve, pelt bottle and cuss each other while fighting, last man standing win the whole ting. Saw the picture recently on the paper Gaulston and Forteau. That's how normally start.

  • What I don't understand (well, I understand it but people already took issue with the basis of my understanding) is how that LEARNED JUDGE could tell some big, old, hard-back, rango men (with a history of violence in their backgrounds -- STEELBAND MEN) to go sit down and have some peaceful and progressive negotiations ... and expect them to ACTUALLY FOLLOW THOSE INSTRUCTIONS.

    That is akin to going down to the border and grabbing the next three ILLEGAL PEASANT MEXICANS and driving them up and then down to SILICON VALLEY and giving them a cubicle and asking them to develop some code to enhance voice communications TECHNOLOGY.
